On March 16, 1992 our client,
(a teenage girl), received serious first (1st) degree and third (3rd) degree burns to her
face, abdomen, hair, arms and legs when a oil tank at a oil storage facility exploded.
Our client and 3 others had
climbed the stairs to the top platform of an old oil storage tank.When
she went to lit a cigarette, the spark from the lighter ignited fumes
that were flowing out of a hatch on top. This manhole cover or

opening was not locked, and in fact was open allowing explosive hydrocarbon
fumes to escape. The
client was taken to a nearby hospital and later transferred to a burn unit
for skin
grafts and further treatment of her burns.

oil tank farm owner alleged that he owed no duty to the burn victim
as she was a trespasser. This argument was successfully countered
by evidence of years of trespassing by the local, including gunshots of

field signs, cigarette butts all over the ground and empty
beer cans and pistol shell casing
all over the area of the oil tanks and oil well pumps. After months of
legal maneuvering, this lawsuit was settled out of court for a
confidential amount.
