In one such case, 13 year old female, named Tykesha,
was a member of a church group that had ventured to a day of fun at
SplashTown outside Houston, Texas. It was a Radio Station Promo-Day,
where free or discounted tickets were distributed and prizes awarded.On
that day,Tykesha a weak swimmer, got on a tube in the wave pool and went
into the deeper water to talk with friends when she quietly fell off
of her tube into the deep water. (This photograph to the left
was taken at the same accident site that a client of the Willis Law Firm
was
found on the bottom of the wave pool. She suffered severe anoxic
brain damage as a result of her near drowning in the SplashTown wave
pool outside Houston,Texas.)
Due to the crowded and noisy conditions that day, she was not
noticed or heard by any of the lifeguards, and was not found until
the end of the wave action, and only then by one of the other guests.
In fact, another guest had to insist upon the guard to enter the water to
check out what appeared to be a body on the bottom. The young girl's
lifeless body was taken out of the pool and CPR was immediately started.
Ambulance was called, and she was transported to a local hospital and
revived. As a result of being without air / oxygen for 5-7 minutes, she
was left severely brain damaged. Even after years of therapy and months of
intense hospitalizations, Tykesha is still suffering from the effects of
anoxic brain damage.The family of Tykesha contacted their family attorney

accidents happen also daily. These include slip and falls, diving accidents,

injuries and drownings. The
accidents in a wavepool however, can be the most deadly. In most
every major city throughout America, a wave pool is waiting for the
unwary. Wave pool injuries and deaths are sharply on the rise, due in part with
their increasing numbers and popularity among swimmers. The first wavepool
was invented in Germany during World War II in order to replicate a wave
environment for submarine tests. Today a typical wavepool is 80-200 feet
wide and 200-300 feet long, and varies in depth from 6-10 feet deep at the
deep end, to only inches deep at the shallow end. Wave pools operate
by a system of air blowing machines that pump air into chambers, that in
turn pushes a wave of water out in the wave pool. Other wave pool
operate by the means of a mechanical paddle that pushes, moves and presses
a wave through a grid into the pool. Some other wave pools operate by the
fast release of a huge torrent of water from the back wall, which produces
a large ocean type breaking wave, used mainly for surfers in these wave
pools. The typical wave sequence is 10 minutes of waves, then a rest
period of 10-15 minutes without any waves in the wave pool. The rest
period allows swimmers to rest and lifeguards to rotate to a new guard
position, and time for the pool to clear out before the cycle starts
up again and again throughout the day. Unfortunately, it is also during
this time that swimmers that had trouble are sometimes found laying
on the bottom of the pool..!!
Problems & Dangers with Wavepools
The
problems with wave pools, is that due to the nature of this beast, many
young and weak swimmers are drawn
to this attraction. They venture out into the 4- 6 foot water thinking
they are safe, then they are hit or
knocked down by a wave or the wave
surge actually can pull them into deeper water. (See the
water surge in this wavepool photo below) Most wave pool rescues of
swimmers in trouble are in the 4- 6 foot of the wave pool. Another problem
arises when these swimmers venture into even deeper water with a rented
innertube,raft or float. These flotation devices have a small warning on
them that they are not a life saving device. This floatation device can be a
death sentence for a weak swimmer who now feels brave and secure. A
non-swimmer can quickly become a distressed victim when a wave knocks them
off of the floatation device. Sometimes due to peer pressure a weak swimmer
desires to join into the group in the deep waters of the wave pool. Also
on crowded day in a wave pool, a knocked off the tube swimmer may have a
difficult time even coming up for air and can even be blocked or
prevented by the tight fit of the tubes on the surface and the strong wave
action present. Water
clarity is a constant safety problem due to the heat,
chlorine, and agitation from the waves themselves. Another problem
added to the confusion, is the addition by the Water Park of loud music
in the area of the wave pool. The level of noise can prevent the guards
from
even hearing calls for distress and the noise also affects their ability
to concentrate on the job at hand.
